Korban Jiwa, Dugaan Pelanggaran BPJS hingga Indikasi Persekongkolan Tender Rp 97,9 Miliar

Medan – Kasus kecelakaan kerja yang menewaskan seorang pekerja di proyek Medan Islamic Centre membuka tabir persoalan serius dalam tata kelola proyek pemerintah. Dari dugaan pelanggaran kewajiban BPJS hingga indikasi persekongkolan tender bernilai Rp 97,9 miliar, proyek strategis milik Pemerintah Kota Medan ini kini berada di bawah sorotan publik dan berpotensi mengarah pada pelanggaran hukum administrasi hingga pidana.


Pembangunan Medan Islamic Centre (MIC) yang digadang sebagai ikon baru peradaban Islam di Sumatera Utara justru menyisakan tanda tanya besar. Proyek bernilai ratusan miliar rupiah tersebut tidak hanya menghadapi persoalan teknis, tetapi juga mulai diwarnai dugaan pelanggaran serius yang berpotensi menyeret pihak-pihak terkait ke ranah hukum.

Proyek yang dikelola oleh Dinas Perumahan, Kawasan Permukiman, Cipta Karya dan Tata Ruang (Perkimcikataru) Kota Medan ini menjadi sorotan setelah seorang pekerja bernama Wahyu Suprio meninggal dunia dalam kecelakaan kerja. Fakta yang mengemuka menunjukkan bahwa korban tidak terdaftar sebagai peserta BPJS Ketenagakerjaan, padahal hal tersebut merupakan kewajiban dasar dalam proyek konstruksi yang menggunakan anggaran negara.

Dalam konteks hukum, kondisi ini berpotensi melanggar Pasal 15 ayat (1) Undang-Undang Nomor 24 Tahun 2011 tentang BPJS, yang secara tegas menyatakan bahwa pemberi kerja wajib mendaftarkan pekerjanya dalam program jaminan sosial. Pelanggaran terhadap ketentuan ini dapat dikenakan sanksi administratif hingga pidana sebagaimana diatur dalam peraturan turunannya.

Lebih jauh lagi, kelalaian dalam menjamin keselamatan kerja dapat masuk dalam ranah pidana berdasarkan Pasal 359 Kitab Undang-Undang Hukum Pidana (KUHP), yaitu kelalaian yang menyebabkan hilangnya nyawa orang lain. Dalam praktik hukum, jika terbukti bahwa perusahaan atau pihak terkait lalai dalam memenuhi standar keselamatan dan perlindungan tenaga kerja, maka tanggung jawab pidana dapat dikenakan.

Namun persoalan tidak berhenti pada aspek ketenagakerjaan. Dugaan pelanggaran juga mengarah pada proses pengadaan barang dan jasa pemerintah. Tender proyek senilai Rp 97,9 miliar yang dimenangkan oleh PT JSE kini menjadi sorotan karena diduga tidak memenuhi prinsip transparansi dan persaingan sehat.

Data yang beredar menunjukkan bahwa nilai kontrak hanya turun sekitar 1% dari Harga Perkiraan Sendiri (HPS) sebesar Rp 99,7 miliar. Dalam praktik pengadaan, selisih yang sangat tipis ini kerap menjadi indikator awal adanya tender yang tidak kompetitif atau bahkan diduga telah “diatur” sebelumnya.

Lebih serius lagi, muncul dugaan bahwa perusahaan pemenang tender tidak memenuhi syarat administrasi, khususnya terkait kewajiban BPJS bagi tenaga kerja. Jika dugaan ini benar, maka proses evaluasi oleh Kelompok Kerja (Pokja) pemilihan dapat dianggap melanggar prinsip dasar pengadaan sebagaimana diatur dalam Peraturan Presiden Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah.

Dalam perspektif hukum pidana, apabila terbukti terdapat persekongkolan dalam proses tender, maka hal ini dapat dijerat dengan Pasal 22 Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat, yang melarang persekongkolan dalam penentuan pemenang tender.

Selain itu, jika terdapat unsur penyalahgunaan kewenangan oleh pejabat yang terlibat, maka potensi pelanggaran dapat merambah ke ranah tindak pidana korupsi. Pasal 3 Undang-Undang Nomor 31 Tahun 1999 jo. UU No 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi menyebutkan bahwa setiap orang yang menyalahgunakan kewenangan yang merugikan keuangan negara dapat dipidana.

Indikasi ini semakin menguat ketika melihat fakta bahwa dari belasan peserta tender, hanya satu perusahaan yang benar-benar mengajukan penawaran hingga tahap akhir. Kondisi ini menimbulkan pertanyaan mendasar: apakah proses tender berjalan secara sehat, atau hanya sekadar formalitas untuk melegitimasi pemenang yang telah ditentukan?

Jika terbukti bahwa proses tersebut direkayasa, maka praktik tersebut dapat dikategorikan sebagai persekongkolan tender horizontal maupun vertikal, yang tidak hanya melanggar hukum administrasi, tetapi juga berpotensi menjadi tindak pidana.

Di sisi lain, proyek Medan Islamic Centre bukan kali pertama menjadi sorotan. Pada tahap sebelumnya, proyek ini juga sempat dikaitkan dengan dugaan kejanggalan dalam pengadaan material, termasuk kasus tanah timbun yang disebut-sebut bernilai miliaran rupiah meskipun materialnya diduga diperoleh tanpa biaya.

Namun, akumulasi fakta dan dugaan yang berkembang telah memenuhi syarat sebagai indikasi awal (early warning) yang seharusnya segera ditindaklanjuti oleh aparat penegak hukum.

Jika tidak, maka risiko yang lebih besar akan muncul: normalisasi praktik-praktik menyimpang dalam proyek pemerintah, yang pada akhirnya merusak sistem pengadaan dan kepercayaan publik.

Kasus Medan Islamic Centre kini tidak lagi sekadar proyek pembangunan fisik. Ia telah berubah menjadi cermin dari bagaimana tata kelola anggaran publik dijalankan—apakah benar-benar untuk kepentingan rakyat, atau justru menjadi ruang bagi praktik-praktik yang menyimpang.

Pertanyaan yang kini mengemuka bukan lagi sekadar siapa yang salah, tetapi sejauh mana negara hadir untuk memastikan keadilan—baik bagi pekerja yang menjadi korban, maupun bagi publik yang berhak atas transparansi penggunaan uang negara.
