Bukan Soal Sistem, Ini Soal Mental Bangsa: Demokrasi Tersandera Lemahnya Penegakan Hukum

Jakarta – Semua mulai dari Presiden yang permisif dalam penegakan hukum, tidak teguh menegakkan hukum kebenaran dan para pemimpin partai yg rakus kekuasaan juga uang. Perdebatan mengenai mekanisme pemilihan kepala daerah kembali mengemuka ke ruang publik. Wacana agar kepala daerah dipilih oleh DPRD—bukan secara langsung oleh rakyat—memantik respons beragam dari partai politik. Partai Gerindra dan Partai Golkar menyatakan dukungan, sementara PDI Perjuangan (PDIP) menolak tegas dengan alasan hak rakyat tidak boleh dirampas.

Namun, di balik hiruk-pikuk perdebatan itu, ada persoalan yang jauh lebih mendasar dan sering kali sengaja dihindari: krisis mental taat hukum dan lemahnya penindakan yang tegas dari pucuk kekuasaan. Selama akar masalah ini tidak disentuh, perdebatan soal sistem hanyalah pergantian bungkus—bukan solusi.

Sistem Boleh Berubah, Mentalitas Tetap Menentukan

Sejarah politik Indonesia membuktikan satu hal: sistem apa pun bisa rusak bila dijalankan oleh manusia yang gemar mempermainkan hukum. Pemilihan langsung yang digadang-gadang sebagai buah reformasi pun tak luput dari problem klasik: politik uang, mobilisasi aparatur, manipulasi regulasi, hingga pembiaran pelanggaran yang terang-benderang.

Sebaliknya, pemilihan lewat DPRD—yang diklaim lebih efisien dan minim konflik—menyimpan risiko lain yang tak kalah serius: transaksi tertutup, oligarki politik, dan pemusatan kekuasaan pada segelintir elite. Dalam kondisi mental hukum yang rapuh, kedua sistem sama-sama berpotensi melahirkan pemimpin hasil kompromi kepentingan, bukan kehendak publik.

Karena itu, mempertentangkan sistem tanpa membenahi mental dan penegakan hukum ibarat mengganti kemudi kapal yang bocor. Arah mungkin berubah, tapi kapal tetap karam.

Demokrasi Bukan Sekadar Prosedur

Demokrasi kerap direduksi menjadi ritual lima tahunan. Padahal, substansinya adalah kepastian hukum, keadilan, dan akuntabilitas. Tanpa ketiganya, demokrasi berubah menjadi panggung sandiwara: aturan ada, tapi tak ditaati; pelanggaran terjadi, tapi tak dihukum.

Di banyak daerah, pelanggaran pemilu diketahui publik, dilaporkan, bahkan diproses—namun berakhir tanpa sanksi berarti. Fenomena ini membentuk persepsi kolektif yang berbahaya: melanggar aturan itu aman, selama punya kekuasaan atau koneksi. Ketika pesan ini mengendap, mental taat hukum terkikis dari atas ke bawah.

Akar Masalah: Keteladanan dan Ketegasan

Dalam sistem presidensial, Presiden memegang peran kunci sebagai simbol dan pengendali arah penegakan hukum. Ketika pelanggaran oleh elite ditoleransi, dinegosiasikan, atau diselesaikan secara administratif tanpa pidana, pesan yang sampai ke publik sangat jelas: hukum bisa ditawar.

Sebaliknya, sejarah juga menunjukkan bahwa ketegasan dari pucuk kekuasaan mampu mengubah iklim. Ketika hukum ditegakkan tanpa pandang bulu, efek jera bekerja; ketika tidak, pembusukan menjadi sistemik. Oleh karena itu, tuntutan publik sesungguhnya bukan pada sistem pemilihan semata, melainkan pada keberanian politik untuk menghukum pelanggar—terutama yang berkuasa.

Mengapa Politik Uang Tak Pernah Mati

Politik uang bukan sekadar persoalan moral individu, melainkan konsekuensi dari impunitas. Selama biaya politik tinggi dan risiko hukum rendah, praktik ini akan terus berulang. Pengawasan yang lemah dan sanksi yang ringan membuat pelanggaran terasa rasional secara kalkulasi.

Dalam konteks ini, mengganti mekanisme pemilihan tanpa memperkuat penindakan hanya akan memindahkan arena transaksi, bukan menghapusnya. Dari lapangan terbuka ke ruang rapat tertutup—substansinya tetap sama.

Hak Rakyat dan Tanggung Jawab Negara

Penolakan PDIP terhadap pemilihan oleh DPRD menekankan hak rakyat sebagai pilar demokrasi. Argumen ini sah dan konstitusional. Namun, hak rakyat juga mencakup hak atas pemilu yang jujur, adil, dan bebas dari manipulasi. Hak tersebut mustahil terwujud bila negara gagal menghadirkan penegakan hukum yang konsisten.

Dengan kata lain, hak memilih tidak boleh dipisahkan dari kewajiban negara menegakkan hukum. Tanpa itu, hak berubah menjadi formalitas.

Efisiensi Anggaran vs Biaya Demokrasi

Pendukung pemilihan oleh DPRD sering mengangkat efisiensi anggaran. Argumen ini tampak logis, tetapi problematik. Demokrasi memang membutuhkan biaya—namun biaya terbesar justru lahir dari korupsi dan pemimpin hasil transaksi. Kerugian jangka panjangnya jauh melampaui ongkos pemilu.

Efisiensi sejati bukan memangkas hak rakyat, melainkan menutup kebocoran melalui penindakan tegas. Tanpa itu, efisiensi hanya jargon.

Ketika Hukum Menjadi Mainan

Masalah paling berbahaya adalah normalisasi pelanggaran. Saat aturan sering diubah demi kepentingan jangka pendek, ketika penegakan hukum selektif, publik belajar bahwa aturan bukan kompas moral, melainkan alat tawar-menawar. Dalam kondisi ini, demokrasi kehilangan ruh.

Di sinilah peran kepemimpinan nasional diuji. Apakah hukum ditegakkan sebagai panglima, atau dijadikan aksesori politik?

Jalan Keluar yang Kerap Dihindari

Solusi substantif sebenarnya jelas namun berat secara politik:

  1. Penindakan tanpa pandang bulu, termasuk terhadap elite.

  2. Penguatan lembaga penegak hukum dengan independensi nyata.

  3. Sanksi tegas dan konsisten untuk pelanggaran pemilu dan kekuasaan.

  4. Keteladanan dari Presiden dan pejabat puncak—bukan sekadar pidato.

Tanpa langkah-langkah ini, perdebatan sistem akan terus berulang, sementara masalah inti tetap tak tersentuh.

Kesimpulan: Demokrasi Tidak Akan Selamat Tanpa Ketegasan

Perdebatan pemilihan kepala daerah seharusnya menjadi pintu masuk untuk refleksi yang lebih jujur. Bukan sistem yang paling bermasalah, melainkan mentalitas dan penegakan hukum. Selama hukum bisa dipermainkan, demokrasi akan terus disandera—apa pun mekanisme yang dipilih.

Bangsa ini tidak kekurangan aturan dan prosedur.
Yang kurang adalah keberanian untuk menegakkan hukum,
dimulai dari pucuk kekuasaan.

Tanpa itu, mengganti sistem hanyalah ilusi perbaikan—sementara krisis sesungguhnya dibiarkan tumbuh subur.
