Medan – Kasus kecelakaan kerja yang menewaskan seorang pekerja di proyek Medan Islamic Centre membuka tabir persoalan serius dalam tata kelola proyek pemerintah. Dari dugaan pelanggaran kewajiban BPJS hingga indikasi persekongkolan tender bernilai Rp 97,9 miliar, proyek strategis milik Pemerintah Kota Medan ini kini berada di bawah sorotan publik dan berpotensi mengarah pada pelanggaran hukum administrasi hingga pidana.


Pembangunan Medan Islamic Centre (MIC) yang digadang sebagai ikon baru peradaban Islam di Sumatera Utara justru menyisakan tanda tanya besar. Pelanggaran terhadap ketentuan ini dapat dikenakan sanksi administratif hingga pidana sebagaimana diatur dalam peraturan turunannya.

Lebih jauh lagi, kelalaian dalam menjamin keselamatan kerja dapat masuk dalam ranah pidana berdasarkan Pasal 359 Kitab Undang-Undang Hukum Pidana (KUHP), yaitu kelalaian yang menyebabkan hilangnya nyawa orang lain. Dalam praktik hukum, jika terbukti bahwa perusahaan atau pihak terkait lalai dalam memenuhi standar keselamatan dan perlindungan tenaga kerja, maka tanggung jawab pidana dapat dikenakan.

Namun persoalan tidak berhenti pada aspek ketenagakerjaan. Dugaan pelanggaran juga mengarah pada proses pengadaan barang dan jasa pemerintah. Tender proyek senilai Rp 97,9 miliar yang dimenangkan oleh PT JSE kini menjadi sorotan karena diduga tidak memenuhi prinsip transparansi dan persaingan sehat.

Dalam perspektif hukum pidana, apabila terbukti terdapat persekongkolan dalam proses tender, maka hal ini dapat dijerat dengan Pasal 22 Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat, yang melarang persekongkolan dalam penentuan pemenang tender.

Selain itu, jika terdapat unsur penyalahgunaan kewenangan oleh pejabat yang terlibat, maka potensi pelanggaran dapat merambah ke ranah tindak pidana korupsi. Pasal 3 Undang-Undang Nomor 31 Tahun 1999 jo. UU No 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi menyebutkan bahwa setiap orang yang menyalahgunakan kewenangan yang merugikan keuangan negara dapat dipidana.

Indikasi ini semakin menguat ketika melihat fakta bahwa dari belasan peserta tender, hanya satu perusahaan yang benar-benar mengajukan penawaran hingga tahap akhir. Kondisi ini menimbulkan pertanyaan mendasar: apakah proses tender berjalan secara sehat, atau hanya sekadar formalitas untuk melegitimasi pemenang yang telah ditentukan?
